Memberships

MEMBERSHIP TERMS AND CONDITIONS USE OF THE FACILITY Your Membership gives you the right to use the facilities for classes and open practices during scheduled opening hours on the terms of these terms and conditions. It does not cover additional costs like food or drink, special classes or privates, which you must pay for separately. We will take all reasonable care to ensure that facilities are available during scheduled opening hours, but sometimes demand from other members or circumstances beyond our control such as equipment failure may mean that the equipment you want to use may not be available. In these circumstances, the Facility may suspend your use of the facilities and your Membership Fees will be suspended until the facilities are restored. FEES AND PAYMENT You agree to pay all the payments as outlined on our website, for your selected membership type and length. During the Initial (Minimum) Term of the Membership you cannot cancel your Membership except as set out in these Terms and Conditions. After the Initial Term, Weekly payments will continue until you advise us of your cancellation of your membership (see “How to Cancel” below). If Membership was paid as a Lump Sum, weekly payments will commence after the Initial Term. You must continue paying even if you do not use the Facility. The Membership rate quoted is a weekly rate and must be paid via MindBody which may be processed on or after the date due, but not before. It is your responsibility to make sure there are sufficient funds in your account and to keep your payment information up to date. Payments are guaranteed not to increase during the Initial Term unless required by law, including any change in the taxes applicable to your Membership Fees (such as a change in the rate of GST). After the Initial Term the rate may be increased by The Garden Pole Dance Studio giving you at least 30 days’ notice in writing which may be by email. If you do not wish to accept that increase you may cancel your membership but must do so before the first payment at the new rate. When payment(s) are missed, any overdue amount will be added to the next MindBody payment. All costs associated with recovery of any missed payments will be added to any amounts due. This includes a $30.00 NZD administration charge, and all reasonable collection agency costs. Termination of your membership by either party does not relieve you from making all payments due up to the date of termination. If you cancel your Membership during the Initial Term without transferring the Membership to another person you must pay a Cancellation Fee that is one third of the remaining Membership Fee amount which will be calculated from the last day of the 6 week notice period to the last day of your Membership (see “How to Cancel” below). If you Freeze your Membership you must pay an Administration Fee of $30.00 NZD per month or part month (see “Freezes” below). If you Transfer your Membership during the Initial Term you must pay a Transfer Fee. The total Transfer Fee is $99.00 and is split so you and the New Member will both pay $49.50 NZD each, which covers administrative costs (see “Transfers” below). STUDIO ETIQUETTE You must comply with Studio Etiquette displayed at the Facility, online or otherwise notified to you in relation to using the Facility. These rules and procedures are designed to allow all members to get maximum benefit from their Membership and may change from time to time. You must not carry out any illegal acts on Facility premises and you must comply with our health and safety requirements. You must respect staff and other members, and you must not take photographs or videos in the Facility without our permission and the permission of every person in the photograph or video. TERMINATION BY YOU If you choose to terminate your contract within the Initial Term, then if you have a special discounted rate for agreeing to an Initial Term you must pay us a Cancellation Fee that is one third of the remaining Membership fee amount which will be calculated from the last day of the 6 week notice period to the last day of your Membership. Alternatively, you can ask us to Transfer your Membership to another person with our consent for the remainder of the Initial Term providing you pay 50% of the $99.00 NZD Transfer Fee ($49.50 NZD) with the New Member to pay the other 50%, providing that person complies with our usual Membership requirements (see “Transfers” below). TERMINATION BY US We may terminate your contract immediately if you carry out any activity which is illegal, offensive, dangerous to other people or to you, if you act in serious breach of Facility rules, or if at any time four or more payments are overdue. If we terminate because of your actions, we will not be liable to you in any way. HOW TO CANCEL After the Initial Term you may cancel your Membership by informing The Garden Pole Dance Studio in writing which may be by email. Confirmation letters/emails/texts will be sent within seven days of receiving a cancellation request. Cancellation will take effect from your net direct debit date that is more than 3 working days after we receive your request. If you wish to cancel your Membership during the Initial Term agreed you must inform The Garden Pole Dance Studio in writing which may be by email at least 6 weeks prior to your last payment, plus you must pay the Cancellation Fee (see “Fees and Payment” above). FREEZES During the Initial Term you can suspend your 12 month Membership and your payments. Each Freeze must be for at least 1 month/4 weeks up to a maximum term of 2 months/8 weeks. Your Initial Term will be extended by the length of Freezes. Any difference in duration must be agreed in writing with The Garden Pole Dance Studio directly. Freezes require 7 days’ notice and an Administration Fee per month or part month will apply (see “Fees and Payments” above). If you use the Facility during a Freeze period, your payment will restart immediately. In all cases, freezing cannot be backdated, and takes effect once a Membership Freeze Form is completed. TRANSFERS If your payments are up to date, and your Membership is either within its Initial Term or you have paid for your Membership in full, you are able to Transfer your Membership to anyone who has not been a Member of The Garden Pole Dance Studio within 12 months of the Transfer date. There can be only one Transfer for each Membership Agreement provided that Member meets our Membership requirements. If you are on a weekly payment Membership, then the New Member simply continues your payments for you. However, you as the Existing Member and the New Member must complete and sign a Membership Transfer agreement. You are responsible for paying 50% of a Transfer Fee at the time of Transfer and for payments until the New Member’s payments begin. GENERAL We may need to make changes to these terms and conditions from time to time. We will give you at least 30 days’ notice of any changes using email/text (unless a change is required for health and safety reasons, in which case such change may have immediate effect). Where we reasonably believe that a change will be detrimental to you (unless it is required by law) we will offer you the right to cancel the Membership Agreement. You may have other rights under the Consumer Guarantees Act or other consumer law. It is your responsibility to use this Facility safely, to take care of your own health and to take care of your own property. Personal injury by accident in New Zealand is covered by the Accident Compensation Act. If a dispute arises between the parties under or in connection with these terms and conditions, the parties must follow the dispute resolution process set out below: The parties will use their best endeavours to promptly resolve any dispute or difference between them by way of good faith negotiations. If the dispute is not resolved by negotiation within 14 days of either party notifying the other of the dispute (or such longer period agreed by the parties), either party may require the other to submit to mediation with assistance of a qualified mediator. If the dispute is not resolved by way of negotiation or mediation within 21 days of notification of the dispute, either party may take steps to relief before an appropriate court. The failure of a party to enforce any provision of these terms and conditions shall not be treated as a waiver of that provision, nor shall it affect that party’s future right to enforce that provision. If any provision of these terms and conditions becomes unenforceable, illegal or invalid for any reason it shall be deemed to be severed from these terms and conditions without affecting the validity of the remainder of the terms and conditions and shall not affect the enforceability, legality or application of any other provision of these terms and conditions.

Ezidebit NZ Direct Debit Request (DDR) Service Agreement (Ver 1.6) This Direct Debit Request Service Agreement (Agreement) forms part of the terms and conditions of your Direct Debit Request (DDR). Specific conditions relating to notices and disputes You agree that Ezidebit (NZ) Limited (the Initiator) must give you at least 10 days' prior notice of each direct debit, provided that where the direct debit is in a series, the Initiator is only required to provide 10 days’ notice prior to the first direct debit in the series. Changes to the amounts or dates of a series of direct debits require 30 days' prior notice to you. You can also agree with the Initiator to receive a same day notice for direct debits specifically requested by you. All notices must be in writing, but can be delivered electronically, if you have agreed that with the Initiator. You can also ask you to reverse a direct debit up to 120 days after the direct debit if: You didn't receive proper notice of the amount and date of the direct debit, or You received notice but the amount or date of the direct debit is different from the amount or date on the notice. If you dishonour a direct debit but the Initiator retries it within 5 business days of the original direct debit, you understand that the Initiator doesn't need to notify you again about that direct debit. Other Terms If you believe that there has been an error in debiting your account, you should notify the Business as soon as possible. The Business will notify you in writing of its determination and the amount of any adjustment that will be made to your nominated account (if any). The Initiator will arrange for your financial institution to adjust your nominated account by the applicable amount (if any). Alternatively, you can also contact your financial institution. You agree that the Initiator will not be liable for any disputed transactions resulting from the supply or non-supply of goods and/or services by the Business and that all disputes will be directed to the Business (as the Initiator is acting only as an agent for the Business). Debiting Your Account By agreeing to the DDR you authorise the Initiator to make debits to your nominated account. You agree that this authority is subject to your bank's terms and conditions that relate to your account. The debit will be processed on the next business day after the direct debit date if: a payment request is received by the Initiator after the Initiator's usual cut off time, being 5:00pm NZ time, Monday to Friday; or there is a public or bank holiday on the day when the debit transaction is due to be processed or on any of the following days until the debit is processed. You authorise the Initiator to attempt to re-debit any unsuccessful payments. You will also be responsible for any fees and charges applied by your financial institution for each unsuccessful debit attempt together with any collection fees, including but not limited to any solicitor fees and/or collection agent fee as may be incurred by the Initiator. The Initiator may charge you certain fees (including setup, variation, SMS or processing fees) where applicable under your debit arrangement. Your Responsibilities It is your responsibility to: Ensure that your nominated account can accept direct debits; Ensure that the details on the DDR are correct, and the bank account has been verified against a recent bank statement; Ensure that all authorised signatories nominated on the financial institution account to be debited authorise the DDR; Ensure that there are sufficient cleared funds in the nominated account, as a failed payment fee may be charged by Ezidebit if a debit is returned by your financial institution as unpaid; Advise immediately if the nominated account is transferred or closed or your account details change; Arrange a suitable payment method if the Initiator or the Business cancels the drawing arrangements. Cancelling or Changing Direct Debits Subject to the terms and conditions of your agreement with the Business, you may cancel, alter or defer the debit arrangement by contacting the Business a reasonable time before the date that the drawing is to be made. Confidentiality We will keep your account details and direct debit records confidential in accordance with the Initiator's Privacy Policy, except where the disclosure of certain information to your financial institution is necessary to enable us to act in accordance with your drawing arrangements. We may disclose the information in the event of an alleged incorrect or wrongful debit, in relation to a claim, or otherwise as required by law. MEMBERSHIP FREEZE POLICY Terms & Conditions During the Initial Term you can suspend your Membership and your payments if you know in advance that you will not be able to attend the studio. All membership freezes are granted at The Garden Pole Dance Studio's discretion. All requests must be received in writing, using the Membership Freeze Form only. Members must provide a minimum of five (5) business days' notice for the pause to take effect. There will be no backdating on applications. In this case, the pause will come into effect upon the next debit/week after The Garden Pole Dance Studio has approved. Memberships can be paused for a minimum of four (4) weeks and a maximum of eight (8) weeks per membership term. Memberships can not be suspended for part weeks. The member may not attend the studio during the pause period. Your Initial Term will be extended by the length of any Freeze. Any difference in duration must be agreed in writing with The Garden Pole Dance Studio directly. Suppose the member cancels after a pause period. In that case, the equivalent amount will be debited from their account until this amount is recovered. Suppose the amount is not able to be recovered. In that case, The Garden Pole Dance Studio will undergo the failed payment policy outlined in the Membership Terms & Conditions. After the initial term has ended, members can freeze their membership once every 12 months. During the Freeze period an Administration Fee of $30.00 NZD per month or part month will be applied. You are not permitted to use the Facility during this time. If you use the Facility during a Freeze period, your payment will restart immediately. Freezing cannot be backdated, and takes effect once this Membership Freeze Form is completed.

MEMBERSHIP UPGRADE POLICY Upgrading your membership can happen at any time during your membership term. All membership upgrade requests must be completed in writing using the relevant form, with a minimum of five (5) business days’ notice. When you upgrade your membership, you agree to the following: The Garden Pole Dance Studio will change all remaining direct debits on your current contract to the amount specified in the new membership drop-down window on the membership upgrade form. For example: if you are upgrading from a Cobra membership to a Python membership, you agree to pay the amount of the Python membership for the rest of the current term (your current membership period). Suppose you do not submit a cancellation or downgrade form by the end of the membership term. In that case, the membership you are requesting to upgrade to now will roll over and be effective in the new term, as per the original membership terms and conditions. You give The Garden Pole Dance Studio permission to update direct debit payments to reflect the amount of my new membership level. You understand that your upgrade will not take effect until your following direct debit.

MEMBERSHIP DOWNGRADE POLICY Need to slow your pole journey down? Members can downgrade their membership at the end of the initial membership term. All membership upgrade requests must be completed in writing using the relevant form, with a minimum of five (5) business days’ notice. When you downgrade your membership, you agree to the following: In the new term, The Garden Pole Dance Studio will change your contract to the amount specified in the New Membership. For example: if you are decreasing your membership from a Python Membership to a Cobra Membership, you agree to pay the amount of the Cobra membership for the new term. You give The Garden Pole Dance Studio permission to update any direct debit payments to reflect the amount of my new membership level. The downgrade will be effective until you submit an upgrade, cancellation or downgrade form.

MEMBERSHIP CANCELLATION POLICY We understand that sometimes you need to take a break, or pole dancing is unfortunately no longer the right fit for you. As a small business, we ask members to make a small commitment of one (1) membership term at a time to help plan and offer great classes, always. As per the Membership Terms & Conditions, the following applies to cancelling a membership. All memberships will continue to renew unless otherwise cancelled. The purchase of a Membership is non-refundable from the first day of the membership term. If you wish to cancel your Membership during the Initial Term agreed you must inform The Garden Pole Dance Studio in writing using the relevant form, at least 6 weeks prior to your last payment. You must pay the Cancellation Fee that is one third of the remaining membership fee amount (calculated from the last day of the 6 week notice period to the last day of your membership term). After the Initial Term you may cancel your Membership by informing The Garden Pole Dance Studio in writing using the relevant form. Confirmation letters/emails/texts will be sent within five (5) days of receiving a cancellation request. Cancellation will take effect from your next direct debit date that is more than 3 working days after we receive your request. Memberships that have been paid in full are non-refundable from the first day of the membership term. Members can only cancel by using the Membership Cancellation Request Form.

General

STUDIO RULES During your visit to the studio, it is a requirement that you do all that is reasonable to minimise the risk of harm to yourself and others. Ensure that you have read the rules below before engaging in any activity on the pole and the studio. Attending the studio Students are not permitted to attend the studio unless all payments and due fees are up to date. Team members reserve the right to refuse entry to any student they deem to be in breach of any studio rule. Leadership will support staff in their decision. We do have neighbours. If you are poling with us during the day, utilise street parking and pop some clothing over your polewear. Follow all reasonable directions given by studio team members. If you are more than 5 minutes late for a class, you will not be able to attend the class. The late rule reduces injury opportunities, as the warm-up is almost over and disruptions it may cause to classes. Place all belongs in the changing area and keep these off the studio floor where possible. You are responsible for your belongings. Remove your rings before class; they can scratch and damage the pole and your rings. Always start your session by wiping down your pole with a towel and methylated spirits spray. Repeat this process at the end of your session – making sure to remove all chalk residue and other substances. Unless you are a The Garden Pole Dance Studio instructor, you cannot teach anything to other students - you may be banned from the studio if caught. Place any items used back to their allocated spot. If you don't know where that is, please ask. Pick up your rubbish and place it in the bins around the studio. When attending the studio, nipples and genitalia are to be covered. Engagement in Activities Always warm up before your session. Do not engage in dangerous activities beyond your limits. Do not engage in activity on the poles if you have been drinking alcohol or taking any medication/drugs that put your safety (or the safety of others) at risk. Do not engage in activities or actions within the studio that harm our business. Do not increase your risk of an incident by wearing products, such as moisturiser, fake tan, and some hair and makeup that come off onto the poles, making them slippery. Do not attempt any tricks in attire that is unsafe and suitable for that manoeuvre. When using the poles, be aware and mindful of those around you to avoid collisions. Only attempt moves that you have learned in class at The Garden Pole Dance Studio within your appropriate ability level. Unless discussed and approved by a team member. Spotting Always ensure that you have a 'spotter' if you are attempting dangerous tricks that you have not yet safely and consistently 'mastered'. Suppose you are unsure whether the trick you are attempting is considered dangerous or whether you need a 'spotter'. In that case, you must first ask a team member (such as an instructor) whether they think you need a 'spotter' for this trick. Suppose you have been doing a trick for a while and feel that you no longer need the 'spotter'. In that case, you must still check with a team member whether they agree that you can perform this move unassisted for the first time. Continually assess your risk before performing a trick, even if you are confident performing it. Strength and ability can fluctuate, and conditions (such as climatic variation and pole condition) can change. Your responsibility is to ensure you minimise the chances of an incident occurring because of your activity on the pole and the studio. A 'spotter' can be anyone in the studio if they understand the technical aspects of the trick being attempted and are physically capable of aiding you in and out of the trick safely if necessary. You must assess whether your spotter meets these requirements. The Garden Pole Dance Studio recommends that advanced students not rely on lower-level students for spotting unless they are sure that they meet the knowledge and capability requirements. Incidents If there is an incident, you are required to let a team member know. Even if you are in doubt if the incident is serious or not, you must advise a team member so that they can assess whether First Aid is required. An Incident Report might need to be completed. Team members in case of an accident or incident that requires First Aid and follow all the instructions necessary for filling out an Incident Report. If you need to use the First Aid Kit, ensure a qualified person attends to your scenario. Advise a team member of any items removed from the First Aid box to purchase replacements. Be Respectful Our Students When your pole friend is down or struggling with a move, cheer louder for them. When they celebrate a win, celebrate with them. If they have a bad day, acknowledge and let them know you are there. Avoid negative body talk. We don’t think we have to tell you to not body shame, but be kind to yourself! All bodies are beautiful and amazing, let’s keep this studio a judgement-free space. The Garden Pole Dance Studio will not tolerate bullying, intimidation or negative talk or behaviours towards another member. We encourage you to photograph/film your progress however please don’t take photos or videos of other students without their prior consent, and be careful of those who may be in the background of any of your content. Please stay off phones while instructors are teaching and talking. Team Members Our instructors and team members love you! For most team members, it is their second job, and they love what they do. They spend countless hours thinking about new things to teach, new ways to make you hurt or amazing choreo. Please show respect to your instructors in class! Please: Be mindful of when they are demonstrating. Sometimes instructors can be upside down for a long time, trying to explain every element you need to achieve the trick. LISTEN. That is all they ask for your undivided attention at this time. Pay attention to their recommendations and listen to their advice. If they are correcting your technique, there is a reason for it. They have trained for this. Trust in them. Don't compare them to one another. We love that our team is so diverse! They are never going to teach the same. They will bring their individual experiences to the class. Diversity is going to give you THE BEST experience. They are all unique, which makes the team here impressive. Our instructors may receive requests from members about that member’s specific circumstances or may provide pole dancing, conditioning, dance, or flexibility training information for educational purposes. They do not offer or provide professional medical advice, diagnosis, treatment, or rehabilitation and may refer the member to third-party resources. Any referrals to official bodies are not intended and should not be construed as an endorsement, promotion, or recommendation by The Garden Pole Dance Studio.

REFUND POLICY This Refund Policy (“Policy”) applies to the following purchases: any goods or services purchased through www.thegardenpole.co.nz, MindBody Software, MindBody App or in-person at The Garden Pole Dance Studio. General We offer refunds, repairs and replacements in accordance with the Consumer Guarantees Act 1993 and on the terms set out in this policy. Any benefits set out in this Policy may apply in addition to consumer’s rights under the Consumer Guarantees Act 1993. Before purchasing from The Garden Pole Dance Studio, please read this Policy to understand your rights and what you can expect from us if you are unsatisfied with your goods or services.

SOCIAL MEDIA POLICY The Garden Pole Dance Studio is a safe space for many people. During your visit to the studio, it is a requirement that you respect privacy and intellectual property. Please consider the following before sharing your pole journey on any social media platform. Intellectual Property The Garden Pole Dance Studio routines and choreography are copyrighted and cannot be shared in full. Any video recording may be used for personal use only (like remembering all that choreo). Instructor routines are the intellectual property of the instructor who created them. You may post with their permission. If you do share, don't forget to credit the instructor. Privacy Privacy laws apply to all our members and are in place for their protection. Do not put members in a situation that could put their jobs, personal life, or themselves at risk by being identifiable in video or video grabs you post. Please ask everyone around you for permission before filming. Ensure you have permission before posting any photos on social media. Alternatively, you can blur other members, so they cannot be identified (including faces and visible tattoos). If students breach this policy, The Garden Pole Dance Studio may terminate their membership.

HEALTH, SAFETY, RULES & CONDUCT POLICY TERMS AND CONDITIONS RULES AND CONDUCT You agree to adhere to all rules provided at the Facility or otherwise notified to you which relate to use of equipment, health and safety (including hygiene), parking, and the day to day operation of the Facility and its surrounding areas. In using the Facility, you must: Upon arrival be respectful of the class in session and keep noise to a minimum while waiting for your class. Remove all jewellery (particularly rings) including body jewellery, prior to using the Facility as they scratch and damage the poles, and can cause injury to yourself and other Members. You are responsible for safe storage of your jewellery (not on the Facility floor as it is easy to lose). Refrain from taking photos or videos of other Members without their prior consent, and be careful of those who may be in the background of any of your content. Participate in a way that is safe for you and others using the Facility. Inform the instructor of any injuries or conditions you may have so that they can make safer adjustments to class content for you. Make sure you understand how to participate in activities safely, and if you are unsure, that you ask for our assistance. Utilise crash mats and instructor spotting safety measures if attempting activity that is new and potentially dangerous for you. If the instructor prohibits you from any activity you must cease this immediately until the instructor allows you to commence with safety measures in place. Apply safe practice when kicking/inverting/dancing near walls/mirrors/other poles/other Members. Apply safe practice when walking near other Members while they are kicking/inverting/dancing. Refrain from allowing another person (especially non-members) to enter the Facility with the intention to watch or participate in classes with you, which is strictly forbidden. Only Members of the studio that are booked into scheduled classes using the booking system can enter the Facility to attend classes. Allowing people to tail-gate or granting non-members access to the Facility poses a safety risk to you, other Members, the person themselves and the Facility, and as such we will take all measures to enforce this rule. If you would like to bring a person to the studio for special purposes (such as to be used as a human prop for an upcoming performance) you must discuss this with an instructor and gain consent ahead of time. Refrain from bringing children to the Facility, as this poses a safety risk to you, other Members, the child themselves and the Facility, and as such we will take all measures to enforce this rule. If you have a reasonable need to bring children to the Facility you must discuss this with an instructor and gain consent ahead of time, and you must supervise them at all times to ensure they do not enter restricted areas or play with any of the stock or equipment. Keep out of restricted areas including; behind the reception desk, shower stall (unless you have obtained consent from an instructor to use this) and all areas in and around the Facility when the Facility is unstaffed or outside of scheduled open hours. Refrain from unplugging, removing, replacing or otherwise tampering with any equipment in the Facility. Place weights and other equipment lightly on the floor after each use. Dress in clothing that you are comfortable in, and proper pole dancing shoes if you wish to wear heels. Be responsible for your belongings. Lockers are available in the changing area for you to use on a first come, first serve basis. Note that if you lose the key you are responsible for paying a replacement fee of $20. If no lockers are available, you must ensure your belongings are stored neatly out of the way of the Fire Exit, any amenities and other Members use of the area. The Garden Pole Dance Studio is not liable for any theft or damage to your property. Keep your class-items (grips, drink bottle, phone, charging cables, etc) placed at the perimeters of the room to avoid trip hazards. Under no circumstances smoke, consume alcohol or illegal drugs on Facility premises or surrounding area. In addition, you must not bring any illegal substances onto the Facility premises or surrounding area. If you are found doing so we may expel you from the Facility and/or terminate your Membership. Act in a considerate and respectful manner towards the instructors and other Members of the Facility. It is forbidden to use inappropriate behaviour such as (though not limited to); loud, insulting, abusive, demeaning language (including though not limited to); disrespecting or marginalising strippers or other sex workers, glorifying or condoning certain body types, or disrespecting others on their gender, sexual orientation, colour, race, ethnic or national origin, age, religious or ethical beliefs, disability, marital status or family responsibilities) or harassing, intimidating, bullying or bothering instructors or other Members. If we find you conducting yourself in a way that jeopardises the health and safety of you or others in the Facility, or you breach any of our Facility rules that causes a detrimental effect to the Facility (or any of its instructors or other Members) we may expel you from the Facility and/or terminate your Membership. Thoroughly wipe down the poles after each use using the cleaning fluid and cloths provided. Spray onto the cloths, then wipe the pole as spraying directly onto the pole can leave the floor slippery. Return all equipment to its rightful place when you have finished using them. Ensure the studio is clean, tidy and ready for the next class. LIABILITY AND INDEMNITY You will be responsible for any loss or damage caused by your use of the Facility. You understand the potential for injury or other dangers related to any form of physical activity including any activity you participate in at the Facility. In consideration of your participation in activity you agree to release & indemnify The Garden Pole Dance Studio as follows: You participate in the exercises and activities at your sole risk and responsibility. You release, indemnify and hold harmless The Garden Pole Dance Studio, including its Co-Directors and instructors, from and against all actions or claims which you may lodge, or may be lodged on your behalf by other parties, arising out of an injury, loss, damage or death caused to you or your property whether by negligence, breach of Agreement, or in any way whatsoever. You also agree that in the event you become injured or your property is damaged, you will bring no claim, legal or otherwise, against The Garden Pole Dance Studio in respect of that injury or damage. The Garden Pole Dance Studio, nor any of our instructors or representatives, will not be responsible for any resulting damage caused by you failing to follow any rules or reasonable directions provided regarding use of the Facility’s equipment. You are solely responsible for your property, including that which you bring into the Facility or onto its premises,) and the security of that property. You should not take any valuables into the Facility, even if you intend to store them inside a locker as the Facility will not be responsible for any loss or damage to valuables brought into the Facility or onto its premises. In compliance with New Zealand Law, neither we, nor any of our instructors or representatives, nor you will be liable for any loss of profits, or any consequential, indirect or special damage or damage or injury of any kind suffered by the other party to this Agreement. Nothing in this Agreement is intended to cause the effect of limiting or reducing your rights against us under the Consumer Guarantees Act 1993 (CGA). As a consumer, you are entitled to certain guarantees under the CGA. If we breach any of these guarantees, your rights of redress are set out in the CGA. HEALTH AND OTHER RISKS Our instructors are not medically trained and cannot assess whether you can participate in activities without risking your health, safety or comfort. We endeavour to keep the Facility at a comfortable temperature for our Members however will attempt to increase / reduce ventilation as required. We keep a First Aid Kit fully stocked and readily available under the sink in the changing area, along with ice packs in the freezer should they be required. You must: Notify us in writing if you have any injury, illness, disability or other condition of risk (including infections or contagious illness) that means you shouldn’t be using The Garden Pole Dance Studio’s facilities. Refrain from using The Garden Pole Dance Studio’s facilities if you suffer from any injury, illness, disability or other condition which could cause further injury, or exacerbate your condition, or present a health risk to instructors or others in the Facility. You confirm that it is advisable that you undertake a medical examination prior to attending the Facility in order to avoid injuries or pressure on your body, though this is entirely at your discretion to do so. Under no circumstances consume alcohol or take illegal drugs prior to entering and participating at the Facility as this poses a safety risk to you, other Members and the Facility, and as such we will take all measures to enforce this rule. If you are found doing so we may expel you from the Facility and/or terminate your Membership. Note it is important to stay hydrated during physical activity and water is available from the kitchenette in the changing area. In the event of an emergency, if the instructor has not already done so or is unable to do so, call 111 for an Ambulance. Key situations that constitute an emergency include: When someone has chest pain or tightness (can also be felt in arm, jaw, upper abdomen) A person has difficulty breathing When someone is choking A person faints or is unconscious Someone is suffering severe pain When there is severe bleeding or bleeding that won’t stop. EMERGENCY EVACUATIONS In the event of a fire emergency remain calm, leave personal belongings and follow an instructor outside through the Fire Exit (front door) to the Assembly Area (refer to Emergency Procedures displayed in the changing area). If the fire is minimal and you feel comfortable to do so without risking your own safety or the safety of others, there is a fire extinguisher located in the changing area for your use. In the event of an earthquake emergency remain calm, safely drop, cover and hold on the floor, away from glass or mirrors, until the shaking has stopped. Once the shaking has stopped and it is safe to exit, get dressed and collect your essential belongings before following the instructor outside through the Fire Exit (front door) to the Assembly Area (refer to Emergency Procedures displayed in the changing area). Follow the advice of the instructor to seek higher ground. Melling sits inside the yellow zone of Tsunami risk, so move to Central Lower Hutt for higher ground.

AGE RESTRICTION POLICY We welcome students of any gender, size, and ability. Although there is no age limit to pole at The Garden Pole Dance Studio, we do require our students to be over the age of 18. This is to ensure all of our students and instructors feel comfortable expressing themselves in a safe, open environment. We occasionally use language that may be inappropriate for younger ears as we embrace the sensual side of pole, alongside the physical fitness aspect of it. Classes

CLASS MANAGEMENT Class Management For all class bookings or cancellations, we use the MindBody software. You can manage your classes using the following platforms: MindBody App MindBody Website The Garden Pole Dance Studio Website How to book (preferred method: MindBody app) Search for ‘The Garden Pole Dance Studio’ on the MindBody app. Find the class you wish to attend under the classes tab. Select “Book”. Choose your payment method (casual pass or membership). Complete your booking. Cancelling Classes The process below is relevant to all class types. Cancellation Window Four (4) hours before the class start time If you cancel within four (4) hours of the class, your class pass will be forfeited. If you are absent from the class, your class pass will be forfeited. It is encouraged to cancel as early as possible to provide students on the waitlist an opportunity to book into the class. It is the responsibility of the member to manage their class schedule. How to Cancel (preferred method: MindBody App) Under the Profile tab of the MindBody app, your upcoming classes will be visible under “Schedule”. Find the class you wish to cancel. Select “Cancel”.

OPEN PRACTICE POLICY It takes time to build strength and technique for pole tricks, and we have open practice rules to protect you and the studio. We take safety seriously. Any student caught breaking these rules may be banned from Open Practice or asked to leave the studio if they continue to break the rules. If you want to learn specific tricks, book a private lesson with an instructor and tell them your wish list. Rule 1: Never teach another student of a lower level anything at all! No tips, no suggestions, no advice! If a student needs help, please ask an employed instructor. Rule 2: Students are never permitted to teach another student tricks (even students of the same level). Rule 3: You must only practise tricks you have learned in class here that you feel confident doing on your own. If you want to learn a trick you have seen a picture or video of, please ask an instructor or do so at home. Just because it is on Instagram doesn’t necessarily mean it is described or performed correctly. Also, you may not have the strength or skill set to try it just yet. We want to keep each of you safe in our studio; therefore, these rules exist. Please keep them in mind when enrolling in Open Practice.

STUDIO HIRE POLICY Studio Hire is available outside of timetabled hours. When hiring The Garden Pole Dance Studio, you will have full access to 45mm stainless steel poles. This is perfect for competition practice, photoshoots or pole jams. Terms & Conditions Studio Hire is only available outside of timetabled hours. Studio Hire rate is an hourly rate, which is dependent on reason for the hire (personal / commercial). Price does not include clean-up costs. Participants are responsible for ensuring the studio is in the same condition as when they arrived. Anyone who intends on using the poles during studio hire must have prior pole dancing experience and sign a waiver, if not a current member of The Garden Pole Dance Studio. Participants are not allowed to teach or instruct during their studio hire unless they have the correct qualifications to do so, and this must be approved prior to hiring. No alcohol is to be consumed on-premises unless this has been discussed and agreed to prior to the event. Participants may be personally liable for any damages that occur during their hire. Payment is required at the time of booking. Cancellations or changes to the studio hire must be completed more than 48 hours prior. All monies paid will be forfeited if cancellations or changes occur within 48 hours. For all studio hire bookings or cancellations, we use the MindBody software. WORKSHOP POLICY For all workshop bookings or cancellations, we use the MindBody software. You can manage your workshop bookings using the following platforms: MindBody App MindBody Website Payment for workshops is required at the time of booking. Workshops are non-refundable but can be transferred to another student up until one (1) hour before the scheduled event. PRIVATE LESSON POLICY For all private lesson bookings or cancellations, we use the MindBody software. You can manage your private lessons using the following platforms: MindBody App (preferred method) MindBody Website The Garden Pole Dance Studio Website If the instructor you wish to have a private lesson with is unavailable, please email info@thegardenpole.co.nz Payment is required at the time of booking. Cancellations or changes to Private Lessons must be completed more than 24 hours prior. All monies paid will be forfeited if cancellations or changes occur within 24 hours. You are allowed one (1) reschedule without forfeiting the cost of the private session. Please note that if you do not provide the required notice or miss the rescheduled session, the cost of the private will be forfeited. If a Private Lesson is booked for a group of 2 or more people, and someone cancels their booking, the pricing for the lesson will change to the applicable rate. For example, if a booking for two (2) people and one person changes their mind; the remaining person will need to pay the 1:1 rate.

POLE PARTY POLICY Pole Parties are a great way to celebrate birthdays, hens’ nights, and so much more. When booking a pole party at The Garden Pole Dance Studio, you are booking an experience that we guarantee you will not forget. Packages: BASIC PACKAGE (60 minutes) $80 booking fee + $35 per person The minimum spend is $360.00, which covers 8 guests. Additional guests are $35.00 each. Includes: 60 minute party, pole tricks and dance taught and a complimentary glass of bubbles. DELUXE PACKAGE (90 minutes) $80 booking fee + $45 per person The minimum spend is $440.00, which covers 8 guests. Additional guests are $45.00 each. Includes: 90 minute party, pole tricks and dance taught, a lesson in lapdance and a complimentary glass of bubbles. PREMIUM PACKAGE (90 minutes) $80 booking fee + $65 per person The minimum spend is $600.00, which covers 8 guests. Additional guests are $65.00 each. Includes: 90 minute party, pole tricks and dance taught, a lesson in lapdance, a group photoshoot, a complimentary glass of bubbles and a sharing platter. Available Days You can book your pole party on a Friday evening after 8:30pm or Saturday and Sunday from 2:00pm (subject to availability). Bookings Booking requests can be made by completing the Pole Party Request Form. Please provide as much information as possible when completing the request form. The Garden Pole Dance Studio will be in contract within two (2) business days to confirm availability. A booking fee of $80.00 is required to confirm your booking. You do not need exact numbers to book. Final numbers are required four (4) business days before the booking, and the final payment is to be made 48 hours before the pole party. This can be done over the phone. Cancellations If you cancel two (2) weeks or more before your event, you will receive a refund, minus a $80 Cancellation Fee. The Garden Pole Dance Studio will not refund any cancellations within two (2) weeks of your event.
